Exemption is not permission to skip the code.
IMC 105: exemption is not permission to violate the code. Starting before the permit is issued is a 108 problem. A set that covers more or less than the permit is a stop-work problem.
Educational 2024 IMC 105. Confirm adopted edition and AHJ procedure. This is not a permit application. Model-code text may use 180-day periods — local adoption can change, delete, or replace them. Do not assume a universal duration, one-extension limit, or fee.
- 105.1: the 2024 IMC model path generally requires authorization before covered work. Emergency sequencing, notice, and application timing are local — get them in writing.
- 105.1.1–105.1.2 annual permits: for facilities with in-house trades; keep detailed records available to the code official.
- 105.2 no permit needed (model list): certain portable equipment, minor parts, internal piping within listed equipment, and self-contained refrigeration ≤ 10 lb or ≤ 1 hp. That exemption is not a code holiday.
- 105.3–105.4: AHJ form, fees, stamped drawings govern. Partial permits at the applicant’s risk. Approval never authorizes a violation.
- 105.4.5–105.4.7: AHJ may suspend/revoke permits issued in error or on incorrect information. Post the permit. Keep stamped drawings accessible through completion.
Scope mismatch
The field adds mechanical work that was not on the approved set, or drops scope without an amendment. Track application-abandonment and issued-permit deadlines separately — they may run concurrently.
