IMC 113: do not assume a five-member board, staggered terms, or that a prior written decision still controls. Confirm the current ordinance, roster, quorum, and whether the decision is final or subject to rehearing or judicial review. This is not legal advice.
Educational 2024 IMC 113. Confirm the controlling local procedure. Distinct from 112 means of appeals (grounds) and 104 (the official cannot waive).
- 113.1 local structure: do not assume a five-member board, staggered terms, or specific member qualifications. Confirm the current ordinance, roster, appointing authority, terms, and vacancies.
- Quorum and decisions: confirm local quorum, voting, record, written-decision, and service requirements. A model-code description is not a substitute for the current local procedure.
- Hearing administration: who presides, who maintains the record, where submissions must be delivered, who issues the decision.
- Decision effect: confirm whether the decision is final, subject to rehearing, administrative review, or judicial review. Obtain legal guidance when property, enforcement, or appeal rights are at stake.
Before filing: ask the clerk for the current roster, term expiration dates, and the hearing calendar. Avoid filing right before a membership change. Pull prior written decisions if available — do not assume expired-term precedent still applies. If the project has systems not covered by the IMC, that gap is resolved by the code official using test data, technical opinion, or published standards — not by the design team acting unilaterally.
Filing on a stale roster
Do not treat a board decision as automatically final in every jurisdiction. Do not leave code gaps undisclosed on M-001 — the reviewer will find them.
