IMC 104: the code official can interpret the IMC and cannot waive it. Listed does not mean approved for this application. Alternatives need written AHJ acceptance before the work — not after inspection fails.

- 104.1–104.2: the code official enforces the IMC and can issue written interpretations and policies — but cannot waive requirements. An interpretation explains what the code means; it cannot lower the standard.
- 104.2.1 listed: evaluated by an approved listing agency to a specific published standard and edition, listing mark or evaluation report, installed within the conditions of that listing and the manufacturer’s instructions. A product listed for residential use is not automatically listed for a commercial application.
- 104.2.2: the official may require engineer-sealed opinions, technical reports, or testing by approved laboratories. Cost of testing is borne by the applicant. Verify the lab is acceptable before commissioning tests.
- 104.2.3 alternatives: may be approved if they meet code intent and are equivalent in quality, strength, effectiveness, durability, safety, and fire safety. Expect a written application/decision. Pre-coordinate before the set is submitted.
- 104.2.4 modifications: case-by-case for practical difficulties without reducing life / fire / structural / accessibility safety. Relief is very limited in flood hazard areas.
- 104.9 reuse: install as approved; reuse only if in good working order and approved. Confirm in writing before scheduling installation.

Alternate after the fail
104.2.3 submitted without AHJ pre-coordination is frequently rejected because the reviewer cannot approve it without escalation. Put the written pre-approval in the permit set. Do not reuse equipment without written confirmation of condition.
