🧠 Plain English Breakdown•Unlawful acts (114.1): It’s illegal to install, alter, repair, remove, or use mechanical systems in conflict with the IMC.•Notice of violation (114.2): The code official issues a written notice/order directing you to stop the illegal condition and abate it.•Prosecution (114.3): If you don’t comply, legal counsel can seek injunctions, corrections, or removal (including ending unlawful occupancy).•Penalties (114.4): Violations are a chargeable offense; actual fine/jail amounts are set by the jurisdiction. Each day the violation continues is a separate offense.•Abatement (114.5): Penalties don’t limit the jurisdiction’s power to restrain, correct, or stop unlawful work or use.•Unsafe systems (114.6): Systems that are unsafe or hazardous are a public nuisance and must be repaired, rehabilitated, demolished, or removed.•Condemn/disconnect (114.6.1–114.6.3): The code official can order removal/repair, disconnect utilities (per 109.3), and prohibit reconnection until authorized.🏗️ Why It Matters in Design & ConstructionViolations escalate quickly—from a notice to stop-work, fines, forced demo, utility cutoffs, and legal action. For owners, engineers, and contractors, the cheapest path is prevention: build exactly to the stamped set, listings, and manufacturer’s installation instructions (MI); when conditions change, revise and re-approve—don’t “field-fix” and cover.🔧 Field TipRun a Violation Response Playbook the moment a NOV (Notice of Violation) hits:1.Stabilize: Stop affected work; LOTO (lockout–tagout) if any hazard; post shutoff locations.2.Document: Photos, as-found sketches, involved sheets/details, listing/MI pages.3.Plan: Create a corrections log with owners/GC/subs (scope, code cite, fix, date).4.Engage AHJ: Email a written abatement plan & timeline; request a quick alignment call.5.Execute & verify: Make fixes; keep work visible for reinspection; don’t reconnect utilities until authorized.6.Prevent: Add the corrected detail to your QC checklists so it doesn’t recur. If you want my 1-page Violation Response Playbook to drop into your next project manual, comment “NOV” and I’ll share it.
